Project: Combined Phase I/II Investigation
Description:
The lending institution retained DES to perform a Phase I ESA on behalf of the
buyer. During the research phase of the project, we discovered that the property
formerly contained a gasoline station. The project turned into a combined Phase
I/II investigation and we discovered a major contamination problem on the site
before the deal was closed. The loan was restructured, money was escrowed for
cleanup, and the deal closed in a manner protective to our client. Soil
remediation was performed by the buyer and the site is presently being monitored
for gasoline constituents in groundwater. The buyer is presently seeking
reimbursement for monitoring from the CTDEP UST Petroleum Clean-Up Fund.
